During the January 1 to June 30, 2020 reporting period, BNSF continued to coordinate with WDNR, EA (WDNR design contractor), and the City of Superior regarding the Pickle Pond restoration project.
On February 21, 2020, BNSF provided comments on (1) a letter from the WDNR to BNSF dated January 9, 2020 with an accompanying December 19, 2019 Technical Memorandum prepared by EA, both of which were received by BNSF on January 9, 2020; and (2) the January 2020 Remedial and Habitat Design â Conceptual Design Report, Pickle Pond Remedial and Habitat Design, Superior, Wisconsin, prepared by EA, received by BNSF on January 14, 2020.
On March 19, 2020, WDNR submitted a letter to BNSF, in response to the February 21, 2020 letter from BNSF, and formally requested BNSF approval of proposed anticipated improvements to Pickle Pond by enlarging and increasing the number of openings in the embankment, including on property owned by BNSF between Pickle Pond and Barkers Bay.
On April 9, 2020, BNSF submitted a letter to WDNR and the City of Superior to (1) provide an update on the preliminary internal consideration of the proposed potential disposition of certain property near Pickle Pond, including the embankment; and (2) provide an initial response to the technical elements of a March 19, 2020 letter from WDNR and the March 6, 2020 Technical Memorandum entitled Pickle Pond â Water Quality Model Report, prepared by Wood.
On June 17, 2020, BNSF submitted to WDNR and the City of Superior draft agreements identified as the Real Estate Donation Agreement and the Amendment and Assignment Agreement related to the potential transfer of certain BNSF-owned property adjacent and proximate to Pickle Pond to the City.
