During this time period, Superior Water, Light & Power (SWL&P), together with Foth Infrastructure & Environment, LLC (Foth) advanced the following efforts: (1) Obtained DNR approval of the RAOR on January 28, 2021; (2) Submitted the 60% Remedial Design Action Report, Field Sampling Plan, Air Management Plan, Quality Assurance Project Plan, and Erosion Control Plan and associated review fee to DNR on March 23, 2021; (3) Received DNR comments on the 60% remedial design (RD) deliverables on April 20, 2021; (4) Provided a response to DNR comments on the 60% RD deliverables on May 21, 2021; and (5) Participated in various meetings with DNR to discuss the 60% RD deliverables and DNR comments. SWL&P has requested that DNR respond to their May 21, 2021 comment response letter. Once those comment responses are received, SWL&P and Foth plan to schedule a meeting with DNR prior to (or concurrently with) submitting 90% RD deliverables. Due to the comment response and resolution cycle, the construction of the remedial action has been delayed with a new goal of constructing the remedial action in the summer of 2022. Also note that during this time period, SWL&P was accepted into the Great Lakes Legacy Act (GLLA) program, and SWL&P and GLNPO are in the process of finalizing the Project Agreement. As soon as that is signed, SWL&P and Foth will move forward in preparing a Sediment Focused Feasibility Study under EPA and DNR oversight.
