During the July 1 to December 31, 2022 reporting period, BNSF continued to coordinate with WDNR, EA (WDNR design contractor), and the City of Superior regarding the Pickle Pond restoration project. On July 22, 2022, BNSF provided comments on the Pickle Pond Remedial and Habitat Design Final Design Report, prepared by EA, and received by BNSF on June 24, 2022. BNSF participated in a site visit with WDNR on August 10, 2022 to review certain aspects of the design and related BNSF comments. On August 26, 2022, BNSF participated in a conference call with WDNR, EA, and the City of Superior to discuss WDNR responses to comments on the Final Design Report, which were received by BNSF on August 4, 2022. BNSF provided additional comments on the Final Design Report on August 31, 2022, and the Restoration Long-Term Maintenance Plan on September 3, 2022. The revised, final Pickle Pond Remedial and Habitat Design Final Design Report was received by BNSF on September 6, 2022.
BNSF also continued to coordinate with WDNR and the City of Superior regarding draft agreements related to the potential transfer of certain BNSF-owned property adjacent and proximate to Pickle Pond to the City. BNSF provided revised agreements to WDNR and the City of Superior on November 3, 2022.
